Counter-Notification
If you believe your content was removed or disabled as a result of mistake or misidentification, you may file a counter-notification. Your counter-notice must include:
- Identification of the material that has been removed or disabled and the location where it appeared before removal.
- A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled due to mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the Federal District Court for your judicial district, and that you will accept service of process from the person who provided the DMCA notice or their agent.
- Your physical or electronic signature.
Once a valid counter-notification is received, Nuxera may restore the removed material, unless the original copyright claimant files a court action seeking to restrain the alleged infringement.
Repeat Infringer Policy
Nuxera reserves the right to terminate access or accounts of users who are found to be repeat infringers. We also reserve the right to remove any content that allegedly infringes another person’s intellectual property, at our sole discretion, without prior notice.
